    Default Is it Legal to Guarantee an Employee a Minimum Number of Hours

    A physician in a Maryland medical clinic works on an hourly basis, but is guaranteed a minimum number of hours.

    The clinic has been acquired and, although the staff was promised that there would be no change to the compensation structure, the new company claims that the arrangement violates labor laws. The new company wants to eliminate the minimum and pay strictly by the hour.

    Is it unlawful to guarantee a minimum number of hours of compensation?

    It sounds like the new owner is trying to shave costs, and is trying to bluff you into agreeing to a less favorable pay structure. On the facts stated, I am not aware of any state or federal law that would prohibit an employer from guaranteeing you a minimum number of hours.

    As a physician, you are probably working under a contract that is a year or more in duration. Once your contract expires, it is up for renegotiation. But while it remains in effect, your compensation structure as set forth in the contract is something that you can enforce (if necessary).

    Consider having your contract reviewed by a labor lawyer in your state, to get some advice on your rights under the contract and anything within the contract that might allow the new company to adjust the pay structure during the contract term.
