    Default Can Employers Find Out About Crime Reports You Made in the Past

    My question involves labor and employment law for the state of: Washington State and California
    Possible employer lives in CA. I live in WA.

    I have never been arrested and never charged with any crime. However, I have been turned down for teaching jobs and I suspect it is because I reported a "crime" to a therapist while doing therapy and she reported it to the police. It had to do with "memories" from over 30 years ago. I have read the scholarly research and legal reports about these types of things. Some say they really happened and some say they are not real. I do not know what to believe. My understanding is that memories are not allowed in a court of law.

    That is the only thing I can imagine is barring me from teaching and other employment where they might have access to this sort of information because I assume that this would not show up on a regular background check.

    Now I have a well known licensed therapist that wants to hire me to do historical and archival research only. Do I just explain this to her or not mention it at all?

    I have unable to find employment so do not have money to fight this in court if that is what it would take to clear it. What would clear it? It is just a police report I guess. Can't anyone file a police report?

    i am confused what exactly are you trying to clear? You shouldn't have a record for reporting a crime through a therapist to the police. I am not sure how you think potential employers would even find out that you have. I am not exactly sure what you think you can fight in court. Public records are just that. Have you searched your name in the county that this happened in?

    Are you getting interviews off your resume/experience? Do you have other work history? I honestly doubt this would keep you from getting a job unless they are finding it, finding who your therapist was and asking for a reference (which would be digging pretty deep).

    Honestly I would stop mentioning it at all, because by doing so you may seem way to focused on it.

    There is no way an employer would know that you reported a crime unless you tell them.

    Don't tell them.

    I’m wondering if, somewhere among the line, the fact or reason op was attending therapy isn’t what’s tripping him/her up. Given op is in some sort of teaching occupation, prior mental health issues could be a big problem.

    If so, then the OP needs to stop mentioning it to employers. That is not information that would be discovered in a standard employment background check.

    There is no real way that a potential school employer would ever find out about what you said to a therapist unless you told them. It is possible to find out about police reports with your name as these can be public records. However, local public records checks that involve inquiries with local police departments are unheard of in a pre-employment check for teachers; possible, but not at all likely.

    It may be that any issues you have might have are apparent in your interview. Or, your employment or other public history are what is keeping you from employment as a teacher.
