    Default Re-Entry After Deportation Due To Felony

    My brother was deported a little over 5 yrs ago. He was convicted of a felony of drugs. he left behind 4 children all citizens of the US, Our mother who became a citizen in 1997, an older brother and my father. he was deported to acountry that he knows nothing about other than he was born there. I believe he was given a 5 year bar. we would like to begin the paperwork to have him bakc with his children. Do we need an attorney or can we file the application ouselves. We were told we had toappeal to the attorney general. He has stayed out of trouble and worked since he was deported. his children need him.my older brother is in the service and agrees to be responsible for him, a sponsor sort of speak. we must we do first and will it help to have a family member in the service agree to be a sponsor or responsible.We really can't afford an expensive attorney for something that is uncertain.Can we begin the process and then if we are not getting anywhere try with an attorney? What are the proper steps? Please help. My mother has many health issues and is afraid that my brother may not be able to be around for her old age.

    If his bar is over he can apply for a visa, but he's not a great candidate to receive a visa. It would make sense for him to work with an immigration lawyer.

    You suggest that you don't want to pay for an immigration lawyer unless you are guranteed that he will be allowed back into the U.S., but nobody can offer that guaranty.

    Unfortunatly immigration laws are strict. I dont want to be a downer but I doubt he will ever be allowed any kind of visa or residence status.
    Hiring a good immigration attorney is your best bet. There are no guarantees when it comes to immigration. They are a system of thier own much like the IRS. They can pretty much do whatever they want
