    Default Rights to a Car Purchased With an Inheritance

    An Illinois couple purchased a vehicle, using funds inherited by the husband. The car is jointly titled. Now they are divorcing. Does the wife have a claim to the car or to part of its value?

    By titling the car jointly, between husband and wife, the husband effectively made the car a marital asset -- he would have the burden of proof, to establish that he both paid for the vehicle exclusively from inherited funds and that, in jointly titling the vehicle, he did not intend to make a gift to the marital estate. The wife will thus have a good chance of being able to claim a 50% share of its value in divorce.
