    Default Marital Debt Payments in an Individual Chapter 13 Bankruptcy

    If you are married and you file an individual Chapter 13 bankruptcy, and you are the sole wage earner in the family, do you list your spouse's debt payments among your expenses? The spouse has credit cards that are solely in her name.

    If you are paying the bills, you will list those debts on your schedules.

    If you have not done so, you should consult a bankruptcy lawyer. Most people find it to be too difficult to file a Chapter 13 bankruptcy and get to the point of the approved repayment plan without the help of a lawyer.
