    Default Filing an I-130 for a Spouse Who is Unlawfully Residing in Canada

    A U.S. Citizen is filing an i-130 for his wife, who presently lives in Canada. However, she is undocumented in Canada. Should he file the I-130 using her address in Canada, or should she return to her nation of origin before he files?
