    Default Unemployment for Part-Time Employees in Any and All States

    My question involves labor and employment law for the state of: actually all

    I am in a disagreement with another poster on another forum about whether unemployment benefits apply to part-time employees. He or she is stating that only FT employees have access to UI benefits at termination. Now assuming the PT worked enough quarters and had enough wages and no other disqualifying reason, is there ANY state that would disqualify ONLY for the reason that they weren't classified by the employer as Fulltime? (I posted about 5 sources but the person stated "Unemployment ABSOLUTELY cares about job status, as you are only eligible for benefits as a FULL-TIME employee. You are so far off the mark here... you are embarrassing yourself. I pray to god you are just some troll and not actually in a position to provide professional assistance in this area.")

    There is no state that I've ever had to deal with that being part time would disqualify you. Off the top of my head I'd say that is about 20 states.

    yeah, he's claiming "all" on a couple of issues (that "all" employees have to be covered under the same benefits, etc) by federal law.....LOL And then calling me out when I disagree with him or her. I guess I need to stop responding....

    Every UI calculation I have seen deals with lookback quarters and wages. And I know SUI calculations for employers have them paying in for every employee. And I know that in TX last year, I had part-time employees who were laid off who received benefits. Why do I let people like this make me wonder if I am incorrect? (would be different if he werent' claiming ALL)

    I've had part time employees approved for benefits also.

    He is simply wrong. And as a general rule if anyone is ever arguing ALL or NONE of anything they are wrong.

    The Connecticut legislature analyzed the issue of what other states do back in 2002 and found that 22 states do allow benefits for part-time workers and 28 did not. While that is certainly a bit dated, my guess is that the numbers haven't shifted a whole lot since then. In particular I doubt few, if any, states that allowed benefits for part-timers have moved to restrict benefits only to full-time employees. So this report might be a good starting point to help disprove that poster's assertion that no state allows part-timers to get UI benefits.     You aren't quoting the meaning of the article correctly.

    In my state and probably all, if you meet the monetary qualifications, and you're a part-time worker, you'll get benefits if let go. The rub in my state and probably the 28 others mentioned is that you canNOT confine your work search to only part-time jobs (actually, I think you can because currently the UI people don't tell you where to apply for work).

    It goes like this if you happen to be some bang up, part-time applicant and the employer says, "hey, we want every hour we can get out of you, and want you full-time (even though the ad said 'part time')," the claimant can't say, "no, I'm a part-time worker." That will be treated as a refusal and adjudicated accordingly.

    In the other 22 states, if the claim is based on part-time work, the claimant can refuse full-time offers of work.

    My statement was not inaccurate, just not as detailed as your explanation. The point is, the report does support the OP's contention (and contrary to his/her adversary on the other site) that part-time employees can get benefits in at least some states, and perhaps all of them if they are willing to change from part-time employment to full-time.

    Anyone who would make an across the board (pun) statement that ONLY full time employees can draw unemployment in ALL states isn't worth arguing with. First question: "Define the term full time." It's unproductive to argue with people who don't know what they're talking about. In a great many cases people who are working part time are doing other things, and have been working part time because it met their needs otherwise for both work and income. In most cases, as pointed out the availability issue becomes an important issue immediately. But unemployment taxes are collected and wages are reported on all employees of covered employers, regardless of the number of hours or amount they are making. There's no exception based on whether someone is classified as part time or full time simply because the unemployment laws (federal) do not work that way. And the states with their individual programs may have a more restrictive law regarding how their program works, what it takes to qualify, but not a totally oppositional law.

    thanks to all who responded and specifically that link....this person actually has now deleted all their posts on the subject (or a moderator did it for them). They just had me questioning myself which i rarely do! And I couldnt' put my hands on anything from a super-legitimate source (like the one provided above!)
