    Default Second MIP With Two Prior DUI's

    hi. i just got my 2nd mip this last monday. i live in michigan. i have one prior minor in possession but it was dismissed after a little bit of jailtime. so first off im wondering if this would count as my first or second dui. my license is revoked because last summer i got 2 dui's and its revoked until july of this year. basically i couldnt care less about the mip but its going to mess up my chances of getting my license back. my court date for the MIP is may 1st, and im wondering if i could delay it until after i've received my license. i think im right when i say that if you arent convicted yet its not on your record yet. that led me to think that i could just not go to court because the county that i got the mip in is not the one i live in and im never there, so a warrant there wouldnt concern me too much. but basically this is what happened at the party, ill just sum it up.

    i got drunk with my friends, kids came over that we didnt know and they apparently wanted to fight. we fought them, they left, they came back with more people. we fought them, they left, then they came back with the police. i went and hid inside the house and locked all of the doors and told the owner's son not to let them in. the cops then kicked down the door, started searching everybody, and then gave us all breathalizers. i know that if i refused it they would just charge me with it for refusing it because its happened before to me.

    all in all, my main concern is that i get my license back in july due to my job security and basically my life security too because if i cant keep this job i cant pay my rent, and i need my license to keep this job. id appreciate all the help i can get because im stressed out like crazy. thanks all

    Until your "main concern" is getting control of your addiction, no one can do anything for you.

    I have to agree with that, as even if you somehow scrape your way out of the current mess you're going to get picked up for another MIP or drunk driving offense a few months from now... maybe sooner.

    A few days in jail didn't work, so what's the judge supposed to think except, "Maybe a longer jail sentence will work"?

    You call this an MIP but you are referring to DUI's. Do you actually mean that this was a "zero tolerance" drunk driving ticket?

    i see where you guys are coming from and i agree. but lately ive kept myself out of any scenarios besides this one that i could actually get in trouble. ie not drinking and driving, not riding around smoking, limited ammount of people etc. i understand that this isnt the best way to go but it is a lot safer for me than i used to be. the 1st mip i received was about 2 years ago, and the dui's were about a year and a half, i got them both in a 30 day period, and one of them was driving under the influence of marijuana in kentucky. but anyways ive been doing a lot better than i used to be and i got an actual job for the first time in a while, and id like to keep it that way because for the most part it keeps me out of trouble by consuming my time. i dont mean to be rude but if youre done preaching to me then id like you to help me please, i know you guys dont know me or nothing but you didnt answer 1 of my questions. and yes they were both 'zero tolerance' tickets for my dui's. if i wasnt so ignorant at the time of the dui's i wouldnt have gotten them, but too late.

    A number of the people who answer here are recovering alcoholics, and a larger number have family members with drug or alcohol problems. Don't think of it as preaching - these are people who've seen the end of the road you appear to have been on.

    A prior "zero tolerance" DUI will enhance the potential sentence for a subsequent violation. MCL 257.625(12)(b). Only one "zero tolerance" DUI can be used to enhance a regular DUI charge. MCL 257.625(26).

    You should never drink and drive period. I dont care if you only had one beer or shot. NEVER means NEVER and no tolerence is there for a reason.
    If you lost a family member because someone decided to drink and drive your view would change.
