    Default Can a Domestic Violence Defendant Evict the Victim

    A couple was living together in a home owned by a partner who has now been charged with domestic violence against the other partner. He has told her that she has to move out of his home, and that if she does not move out he will evict her.

    Can a person who is accused of domestic violence evict the victim?

    Yes, the owner of a home may evict a tenant from the home, even if he has been accused by the tenant of a crime. The owner must follow any applicable state laws and local ordinances governing a landlord-tenant relationship, termination of tenancy, and eviction.

    The owner would have to take care that in doing so he did not violate any no-contact provisions or similar restrictions imposed by the terms of his pretrial release, or any order of protection.
