    Default Can a Landlord Charge a New Fee for a Package Retreival System

    A Florida landlord purchased a system that allows tenants to retrieve packages that are delivered to the apartment complex, and keeps the packages secure from theft after delivery. The landlord has sent tenants a notice that all tenants must pay a monthly fee for the new system, and has not given any information about opting out.

    Can the landlord impose the new fee during a tenant's lease term?

    If the lease does not provide for a fee for the handling of packages on behalf of tenants then, no, the new fee is improper during the remainder of a tenant's lease term. When a tenant's mail or packages are delivered to the landlord's offices and not directly to tenants, the handling of the deliveries is part of the landlord's implicit obligations under the lease.
