    Default Getting Permanent Residency Without a J1 212(e) Waiver

    A man came to the U.S. on a J1 visa, and subsequently became a F1 student. He married a U.S. citizen. He now wants to apply for permanent residency.

    If his J1 visa was subject to the two year HRR, does he need a 212(e) waiver to get permanent residency based on marriage?
