    Default Possession of a Firearm Charge While in Somebody Else's Car

    If you're in somebody else's car, can you be charged with possession of a firearm found on your side of the car? The officer says that he saw the passenger in the seat where the gun was found, and that the passenger moved to a different seat when he saw that they were being pulled over.

    It is possible to be charged and convicted of possession of a firearm, even if you're in somebody else's car. The officer is suggesting activity inside the car that suggests that the person charged knew that there was a gun in the car.

    If the owner has a different explanation for the gun's presence, and the passenger has an innocent explanation for the movement described by the officer, that information should be brought to the attention of the defendant's criminal defense lawyer.
