    Default Bankruptcy and the Deceased

    My father recently passed away but had a lot of debt to his name. I was wondering if the credit cards were only in his name, are we still responsible for his debt? We live in oklahoma

    Oklahoma is not a community property state - any surviving spouse would not be responsible for credit card debts in husband's name only. Also, you or any other family members would not be responsible for debts in you dad's name only. The creditors will need to make a claim against the estate for payment.
