    Default Parking Lot Accident in North Carolina Deemed 'No Fault'

    what exactly is a no fault car accident?

    my mother was in a car accident yesterday(in North Carolina). a woman hit her (due to sppeding) in a parking lot. the police officer told us that it was a "no fault accident" because it occured in a parking lot. We were also informed that even though the other driver was speeding, the accident is not their fault...im confused

    The police deemed that neither of you were at fault (or perhaps that both of you were at fault in roughly equal amounts). Your mother was backing out of a space, I'm assuming, when the accident occurred? (If you don't give the details, we're stuck guessing.)

    my mother was already out of the parking space and getting ready to turn off...my mom was making a left turn when the other driver (who was speeding) hit the right side of my mothers car..soo hard even that the two cars were actually stuck together

    the police officer that made the report lied about how the accident occured. luckily the accident happened right outside my mothers job so we have plenty of pictures that show who is actually at fault

    Rarely will the police determince fault in a public parking lot. The insurance companies know this and will negotiate fault internally. Your pictures will definitely be of assistance to your insurance company.

    Keep in mind, the speed of the other car does not relieve your mother from her responsibilty when exiting a parking space. Can you tell me what the speed limit is in a parking lot? I know it's tricky because you usually can't see past mini-vans beside you. I ALWAYS back into my spots to better my odds

    I am a North Carolina attorney and believe that you need to seek out an injury attorney to assist you. I don't know that I have ever heard of a no fault accident. In North Carolina you could be contributorily negligent (if you are even 1% at fault then they don't owe you anything even though they were 99% at fault).

    Police officers often do not get the facts correct on the accident report as they were not there to witness it and have to trust the information given to them by the parties and witnesses. If you can prove that the report is wrong then you can still win your case. It will be very difficult to make a recovery without a lawyer.
