    Default Can You Pursue a Product Liability Case With No Injury

    If you purchase a product and find a potentially dangerous defect, but find the problem before you use the product and suffer injury, can you sue for product liability? Or do you have to suffer an injury first?

    The product is a pocket bike and the frame is improperly welded such that it would be dangerous to ride.

    If you're not injured, you should return the product for repair or a refund. You have a possible cause of action under warranty principles, but not a product liability action.
