    Default Man Charged With Felony Robbery For Petty Theft


    Hi, first I was wondering about the law in CA; Does security have to stop you before you exit the premesis?
    I was told that once you left the store, if someone asked to look in your belongings or bags, you do not have to comply, and security can not detain or otherwise harrass you.

    Okay, now for the DRAMA:

    My friend was shopping at a local 99Cent Store. After he left the store with his purchases, a young security guard approached him in the parking lot and demanded to look in his shoulder bag.

    My friend stated that he was not comfortable with that as his personal items were inside.

    The security guard then sprayed mace directly into my friend's face causing him to flail about in pain.
    The young security employee claims he was hit, however, if he was, it occurred after he assaulted my friend. The police were called subsequently.

    After being maced, My friend ran blindly into the street, fell and seriously injured his knee. Also, He was not allowed by officers to wash his face for many hours thereafter, and suffered additional physical injuries consistent with being beaten.

    He has several psychiatric disorders that, without the correct medications, sometimes cause him to not think clearly.

    The courts are charging him with Felony robbery and want to sentence him to 15 years in prison.

    The alleged unpaid for items they took from his bag amounted to roughly $10.00

    Is this not incredibly messed up?

    I do believe it is, IMO.

    That is incorrect. See, e.g., Jones v. K-Mart, 50 Cal. App. 4th 1898, 1901-02 (1996), in which a shoplifter was detained after leaving the store.
