    Default Co-Tenant Abandoned Lease

    I was on a year lease with a co-tenant/roommate. About 4 or 5 months before the lease was to expire she called me up to say she was moving in 1 week. Since I was actually pretty thrilled with her leaving and she agreed to pay the next month's rent to give me time to find a new roommate, I didn't put up a fight. I called my landlord to get their take, and they told me that as long as I was okay with taking over the entire lease, they would remove her name after she gave them 30 days written notice. My landlord then told me that I would be responsible for giving her her part of the deposit.

    She never gave notice. But she still moved out. I found a new roommate and my lease has since go to a month to month tenancy. I instructed my landlords to remove her name from the lease, since she abandoned the apartment and was no longer paying rent. I believe they did so. My question is about the deposit. I never paid her. She's not going to demand it either. So my landlord has to refund the full $1600 to me, correct? I only paid half of the deposit, and I am a little wary that my landlord will try to refund only the part I paid. I am probably anticipating a problem that won't occur. But I was curious. California law applies.

    Why do you feel you are entitled to her portion of deposit?

    Aside from the serious headaches she caused me, and being stuck with having to pay for all the utilities, and I don't want damages and the like that she caused taken out of my portion...the bigger question is why would my landlord feel entitled to keep her deposit?

    The deposit was paid by both of you whatever deductions are made when you move goes againist both shares. Now on her side she can say she did not cause all the damage because she had moved out and you agreed to le ther leave. What I believe your LL is saying is he will give you the deposit and its up to you to pay her her portion. If you do not and she did not agree to let you keep her portion of deposit she can sue you for her entire share
