    Default Roomate Will Not Take My Name Off Of Lease in Virginia

    I was living with my boyfriend in a townhome and moved to another city for a job before the lease was up. My boyfriend stayed. I moved out January '06 and the lease originally ended August '06. Even though I was no longer living there, I did him a favor and resigned the lease with him in April (my first mistake) so the apartment wouldn't have to run another credit check on him. We broke up in June '06 and were on decent terms so I did not think much about the lease (my second mistake). In January, (after some advice from friends) I decided I wanted my name off the lease just in case anything were to happen. I contacted the leasing office about what I could do and they said I just needed to fill out a notice to vacate, and the exboyfriend had to resign a new lease (that would still end at the same time), up his deposit, and say whether or not I did any damages to the apartment. I gave the exboyfriend my keys and my notice to vacate back in January and he said he'd take care of it, but never did. I went ahead and faxed to the leasing office my notice to vacate a few weeks ago but the ex STILL hasn't resigned the lease. Is there anything I can do to make him do it?? I try to call him and email him, but he doesn't answer when I call and rarely replys to my emails. I've already threatened to take him to small claims for other money he owes me.

    I am skeptical that you have any legal grounds to force him to release you.

    Is he paying the rent?

    Yeah, I was afraid of that...I didn't know if there was anything I could do. As far as I know he's been paying the rent, although the leasing office told me that the rent was late by at least 20 days last month. And I know that there are some damages to the apartment that were not there when I moved out, so I'm worried about my deposit.
