    Unhappy Challenging Wage Garnishment

    I recieved a letter from a creditor saying that I owed them money. The name was wrong on the paper, my first name was correct but my last name wasn't. So I assumed it was a mistake and wasn't for me. A few months later my wages are being garnished for something that I didn't even do. I never had a credit card through these people. I'm trying to figure out what to do to stop garnishment of my wages that is currently happening. I sent a letter to the court, but they said that they could not advise me and they set up a traverse hearing for me. I don't know what i'm suppose to say or do in court over this. I need help

    You're not telling us the whole story. They didn't get a court judgment and garnishment order against you by sending you a letter with the wrong surname. Also, laws are different in each state and you chose not to tell us where you are.

    This is the entire story i got this letter months ago it was served to me by a sheriff and someone told me not to do anything because it's not me. It was my first name but not my last. Obviously it was the right social security number because they found me. Because i listened to someone else they garnished my wages a couple months later. So I sent the court a letter saying that that has never been my last name and that I never had that particular credit card and they scheduled a traverse hearing for me, but i don't know what to say or do at a traverse hearing where i'm representing myself. I live in Georgia

    This is a hearing to determine what? If you were properly served? If you are the person named in the lawsuit?

    Consider hiring a lawyer.
