    Default F-1 OPT Status Tax Exemptions

    I know that my current status exempts my liability to pay social security & medicare taxes... But how about Federal & State taxes? Anyone know if in any chance they can be avoided given the fact that I come from Hong Kong w/ UK citizenship?

    Unless a tax treaty applies to your situation (see IRS Publication 901), you have to pay your taxes just like everybody else.

    International Students (F1, J1) for upto five years, if they are in OPT, CPT have to pay Federal and State Taxes. They need not pay FICA Taxes (Social Security and Medicare Taxes)

    They need to file Form 1040NR, 8843 and Form 843 to get a refund of wrongly paid taxes in OPT.

    This is the advise we got from the tax experts at visataxes.

    In our university, they recommended us to visataxes, and they specialize in taxes for visa holders in US.
