    Default Criminal Statute of Limitations in Ohio

    Is there a "time limit" for charging someone with shoplifting in Ohio? When this time passes, does that mean that I will not be charged?

    --Shoplifted in May of 2006
    --Under $100
    --Told me I would receive a court date
    --Haven't heard from them.

    did you get a ticket/booked from a police officer? or the LP just said 'see you in court'?
    i'm sure its less than a year for the statue of limitations, i don't know and didn't search the net though, just a guess

    yes, the police came. i signed a form...and the LP said i would be getting a court date.

    the LP said i would be getting a court date in about 2 weeks. then the officer gave me a form to sign...i did not end up paying for the items as i never got any mail.

    How many times and different ways are you going to ask the same question ohiogirl?? I remember you asking and getting answers many months ago, people even told you how to find out for yourself. You've got a computer, look it up....you've got a phone, call them up!!

    The Ohio Criminal Statute Of Limitations says,

    (A)(1) Except as provided in division (A)(2) or (3) of this section or as otherwise provided in this section, a prosecution shall be barred unless it is commenced within the following periods after an offense is committed:
    (a) For a felony, six years;

    (b) For a misdemeanor other than a minor misdemeanor, two years;

    (c) For a minor misdemeanor, six months.

    I believe the most common charge for shoplifting in Ohio is "petty theft", which is a first degree misdemeanor. (See Ohio Code 2913.02).

    Oh, so shoplifting wouldn't be "minor" then would it? Two years seems like a long time. In other posts, people mention a year or so...
