You could - but that doesn't mean you will. The prosecutor would have to prove willfull failure to pay to charge you with it and punish for it. If you have been making payments and can prove it - I would think a judge would be lenient if it went before one. If you haven't been trying to pay it off then that will not be good for you if you go before a judge for it.
