    Question Can You Complete a Divorce Without Completing the Financial Disclosures

    Neither of us want to bother with getting together the financial disclosures to keep the separation and divorce as simple as possible. Neither of us has anything of value other than the few things in the house we are both agreeing to split.

    Can we just put a clause in the separation agreement stating we are not requesting, and will not request, financial disclosures? Will that hold up in court if one of us gets a little crazy down the line and suddenly wants it after signing the separation agreement?

    If you truly have nothing of value, then rather than stating that you are not requesting and will not request financial disclosures, then just state that you have already divided all property and that each person will be keeping the property in their possession. However, you probably want to get everything physically divided before you do that.

    The question of what will and will not be acceptable to a court will depend upon the laws of the state in which the divorce occurs.
