    Smile Payment for a Child's Private School After an Increase in Income

    My question involves a child custody case from the State of: New York

    My ex has a reported increase in income by $40,000 (40%), as a result of that an increased in expenses for my child, I am going back for a modification.

    My question is,I would like to enroll my child in Private School (tuition is 8k/year - all in) but I'm wondering if the courts have him pay for a portion?

    Long story short: I used to work 6am - 2 pm and my child's father used to assist with drop off an pick up during the week due to both of our inflexible work hours. Out of the blue he decided that he will only help on Mondays and and I have to make arrangements. I changed my hours to 8-4 however because I work an hour from the daycare I am always late to work and late to pick her up. As a result the daycare has offered aftercare solely for her but only until September. Also after he agreed to help on Mondays he left our child at daycare without any warning and I had to rush out of work to get her. He is completely unreliable.

    We both live in Long Island and they do not offer free pre-k in either of our districts. School starts at 8am and pickup is promptly at 2:30pm with no aftercare provided. The only solution is a school in Queens where we work, however, since we live in Long Island you have to pay tuition to attend a city school no matter what.

    Will the court see this as a reasonable argument? I'm a single mother with absolutely no help at all and after all of my research the only logical solution is private school with a relatively low tuition.

    What do other working parents there do? You are surely not the only parent with this predicament. Have you looked at other care centers?

    How old is your child?

    Some daycare centers offer transportation to and from local public schools. I would try to find one that does this. And in many cases, costs can be split proportionately between both parents.

    My child is 3.5.

    Where I live most families have a stay at home parent, or they work in the area. I've search for other care centers on Long Island but I'm met with the same issue of 10 hour days which start at 8am and close by 5:45. This would be a perfect option if my commute wasn't a little over an hour away. My child's father is all too well aware of this hardship and is using it to his advantage by not helping. I work in Law Enforcement so that hours are terrible.

    Using a childcare center is honestly a short term solution. No matter what she will have to go to school in 2019 and I do not think it is in the best interest of her development to constantly change schools. Of course my opinion doesn't mean too much, I'm not sure how the magistrate would feel. Update: I called 5 daycare centers by my job and they all are at capacity and have waiting lists. *sigh*

    Transportation to and from school isn't really the issue. Its more so the hours of the school. An 8am start and a 2:30-5 end time do not leave enough time in the day for me to get to and from work as well as ensure she is picked up on time. There are no public schools (or private for that matter) in the area that offer early drop off (before 8) or pickup past 5:45.

    I guess my real argument is that a school in the city would eliminate the commuting issue. I'd be open to public schools in the city, however, since I do not live in the boroughs and only work there, you must pay tuition (according to DOE). The difference in tuition is not much, but with the private school you obviously get more for your money.

    Have you considered looking for a new position in a more working parent friendly area or company? Taking a salary cut to simplify your life may be a better solution than the contortions you are now going through.

    I just did a quick google search of daycare centers on Long Island and found many that close at 6:30 pm and one that even closes at 7. Further search shows that many of them have Pre-Kindergarten progams as part of the curriculum at the center to suit your needs for now, as well as bussing to and from public school for when your child begins kindergarten.

    I am a single parent. I drop my daughter off at daycare in the AM before work. They take her to school. Then they pick her up from school take her back to the center, and I pick her up from daycare. It's not ideal, but we make it work because it is what we need to do for me to work.

    I would be surprised if a court required dad to pay for private school over his objections when daycare is the only reason for it, and there are other options available. It's possible of course, but I would be surprised. With a 40% increase in his income however, you are likely entitled to additional child support that you can use to enroll your child at the school of your choice.

    Another option would be to see if a neighbor or parent of one of her classmates would be willing/able to care for your child either in the morning or afternoon and also provide transportation. A parent may be willing to do so on a barter basis - you taking her kid for some time on the w/e or an evening.
