My question involves education law in the State of: New Jersey
Hi everyone, the situation is this:
Public high school.
All observations in final non-tenure year measured as "highly effective".
No issues or problems throughout the school year.
Minor issues last school year that were then addressed satisfactorily, which was one factor that resulted in re-hire for this year.
Department is not undergoing budget cuts.
Only reason for not being given tenure was "we think we can do better". Nothing more.
Has the school acted fairly? Does the teacher in question have valid ground to file a grievance with the NJEA or possibly win a lawsuit if pursued? What are the viable options/rights?
