Right before you posted your response I received a response on another board which I also posted my question. That attorney has indicated that there was no conviction therefore no restrictions. That is what I'd say 98% of the defense attorneys I've spoken or communicated with have all stated.

Your conclusion matches my own which is what set me down this path to try to find some case law where this question has been argued, haven't found anything yet though, however if I do I'll be sure to come back and post the case.

There is no conviction or prohibition under state or federal law. You're focusing on the wrong language of the statute. It does not matter whether there was a period of probation, suspension, or deferral of sentence. Rather, what matters is that there was never a guilty finding entered, and therefore, no conviction.
