    Default Apartment Move-in Date Has Been Repeatedly Pushed Back by the Management Company

    My question involves landlord-tenant law in the State of: California.

    I have arranged to move apartments from one complex to another (owned by different companies) with a move-in date for the new place of March 16th. I have signed the lease and gave the deposit plus application fee and the all the required documents.

    The leasing office reached out to me on March 12th, saying that the apartment have some pests issue and will have to push the move-in date to March 31st. Later they called me and said, pest control may required another round of fix, so they pushed back further my move-in date to April 14th.

    Its already been a month that I am staying at the motel, as I dont have any permanent place to stay. I kept all my apartment stuff in a storage.

    Today April 10th, they called me again saying that, today they found bed bugs and they have to treat it as well. Treatment will start on thursday April 12th and I won't be able to move-in by April 14th.
    When I asked about the other available apartment, they said, they dont have any with the similar floor plan. And they also dont know, when will be my estimated move-in date.

    They offered me with the smaller unit, which I didn't accepted. But I can see larger unit, which are available.

    As I have experienced, if something which I have reserved is not available, companies do offer free upgrades. But it is not happening in this particular case.

    Can anyone guide me, about what are my rights or how to handle such kind of situation?

    You have signed a lease, correct? What provisions are in the lease relating to situations when the unit is not available on the agreed move-in date?

    If you are now hoping to escape the lease, have you tried simply asking the landlord to release you based upon the long delays in their performance?
