    Default Is a Lease Valid After a Change of Property Ownership

    My question involves landlord-tenant law in the State of: Georgia. My fiancé and I moved to Savannah with our son in July. We went through a property management company.The owner of the property we were renting never fixed the issues we had within the home even after constant phone calls emails and texts between us and the property manager who told us she could not get ahold of him either.

    Come December we get a note on our door telling us we have new owners and a new property management company that would be taking over. We were never notified of the changes and still till this day are confused on exactly why we didn’t have to sign a new lease.

    We have nothing in writing stating that we have a legal agreement with these new owners. Does this mean that they can kick us out when we or can we break the lease? We are still dealing with issues in the house that the new owners are taking their time to come look at and fix.. and we pay our rent 3 months in advance

    Unless the new owners acquired the property through a foreclosure sale, the lease remains valid.

    New owners will typically ask tenants to sign an assignment of lease document agreeing that they are the new landlords and should receive future rent payments; but even in the absence of such an assignment the lease remains in effect despite the sale.

    If the property manager remains the same, and the lease requires you to pay rent to the property manager, that may be why you have not been asked to sign any additional documents.

    You can discuss the maintenance issues with the present property manager.
