    Default Do You Need Your Landlord's Approval to Break a Lease Due to Domestic Violence

    My question involves landlord-tenant law in the State of: CA

    My friend is co-leasing an apartment with an ex-bf who has been abusive, she has since been staying with me. She's trying to get off her lease, she's filed a police report and utilize CA section 1946.7 but her landlord is being difficult about it (evasive, talking to their "lawyers", etc.). As far as I'm aware, what she wants to do is perfectly legal, but does she have to get the approval of the landlord or can she just give them the appropriate paperwork and walk away? What's the landlord's rights in this situation?

    This spells out the manner in which she must notify her landlord and the documentation she must provide him in order to avail herself of the provisions of 1946.7. It also spells out what her rights are once she does that.
