I live in Ohio. I had some health issue at the beginning of the year. So I started taking 12-week FMLA in Jan. 2018. My doctor specified that I should be away from work till the end of March. Then she will evaluate my situation again. Due to schedule issue, she cannot see me before the end of FMLA. I have over 200 hours PTO accrued. So I requested to the company to use some of my PTO between the end of FMLA and my doctor appointment. 2nd day after I submitted the request, the company HR informed me that my request to use PTO has been denied due to the fact I do not have an estimated return to work date. In addition, the company cannot hold my position any more and terminated my job.
I am trying to figure out if the company terminated my job because of retaliation on my use of FMLA. I do have over 200 hours' PTO accrued. Why couldn't they give me a little extra time off? If I do launch a lawsuit, do I have any chance?
