My question involves labor and employment law for the state of: New Mexico
So i have been diagnosed by my own psychiatrist with depression, mood disorder, and anxiety. I am seeing my own psychiatrist on my own, and receiving my own help.
My work is doing a background check on me and the first two investigators never asked me about a mental disorder. When I got to my third investigator I accidentally disclosed that I have anxiety, depression, and mood disorder, and disclosed I am currently being treated. Well once I said that she said “would you be willing to see our own?”. I felt really discriminated against and I’m really offended at it because once I said that I automatically got referred to their psychiatrist. She made me sign a form that said if I don’t I could be terminated.
Can my work legally do that to me? I went out on my own good will to be treated for my disorders, but then all of this happened and it makes me feel like I’m being targeted.
