I am in the process of leaving my current job and let it be known to my current employer that I would like to work with a former employee (who was fired). I was told to ask permission in hopes to avoid legal troubles. My current employer said no even after agreeing to stay on to hire and train my replacement. I would be starting a new company under an entirely different job description in an entirely different market (and state). The problem is, my current employer made us sign a combined NCA/NDA that prevents employees from working together for up to two years. My former co-worker is also worried they would try to sue him for poaching even though I approached them. I feel like the document is invalid for several reasons but am unsure if it is worth pursing legal action on my behalf as my employer has the money to do some serious damage if wanted. My reasons for feeling the contract is invalid are:

1. I was told to sign the contract 5 months after I started working.
2. No compensation was provided for signing.
3. They never sent a signed copy back to me.
4. The address listed is a previous company address. The company has moved since me signing the document.
5. There is no radius specified. Meaning it seems very broad.
6. 2 years is a long

What do you all think? Is it work pursing?
