    Default Emancipation of a Minor in West Virginia

    My question involves juvenile law in the State of: West Virginia. I'm Johnna and I'm 16 years old, once I get a job and a car I'm going to try and get emancipated. My parents verbally abuse me to the point that I break down and cry almost everyday. They call me names like idiot, dumbass, stupid, etc. They don't allow me to do anything or go anywhere, they make me clean everyday and buy my own stuff. Sometimes my dad pushes me or slaps me but he says he didn't do it hard but he has. Ive brought up emancipation before and they said they'll just send me off before I get emancipated. I'm scared that my siblings will lie about them being mean to me but even they have said that they treat me like dirt. I have a few questions I need answered.

    Am I able to get emancipated? Can they send me off for trying to be emancipated? What would I tell the judge?

    Emancipation is really very rare. Simply having a job and a car isn't going to get it. You might want to read WV Legal Aid's website on the issue. http://www.lawv.net/Resources/Self-H...ion-of-a-Minor.

    Where do you think they would "send you off" to?

    If you feel you are being abused talk to a school counselor or teacher you trust as a first step.

    On the basis of what you have posted, no, you are not able to be emancipated. Contrary to what far too many folk believe, emancipation of a minor is not an never was intended to be a means for a minor to leave home (no matter how bad the situation may be). Emancipation was and is intended to be a means to provide legal protections to those minors who, for reasons outside their own control, found themselves living on their own.

    If you are being abused call CPS. Have you talked to a school counselor, teacher, priest, etc about what you think is abuse ?.

    What do you think is abusive about you having to clean everyday ? If you don't have a job. Where do you get the money to buy what you need ? As long as you have a roof. What things do you need ? As long as you have a roof over your head, utilities, food and clothing. Legally that is all your parents have to supply.

    Report the abuse to CPS or the police or talk to a trusted adult at school. That's all you can do.
