Could the police and a prosecutor conclude that the person was involved in the illegal sale of a controlled substance? There would be fact scenarios under which it would be possible.
If this is a situation in which you innocently worked to market a product and have now discovered that it contains a controlled substance, you will want to stop. You will then want to consult your lawyer.
If this were a situation in which you are hoping to market such a product and hoping for plausible deniability, the intent to later claim that you didn't know what was in it in the hope of avoiding potential charges, don't do it.
