    Default Can a Child be Removed by CPS Due to an Older Sibling's Drug Use

    My question involves adoption law for the State of: iowa
    So, I am 18 and my parents recently found marijuana in my room. I have an adopted brother—about 18 months old. The adoption is finalized and there are no more home visits. 1.if I was caught w/ weed by cops could my brother get taken and 2. If a cop somehow found a pipe but no weed could he get taken?

    My parents freaked out on me saying “how could you be so selfish as to smoke pot when your brother could be taken away?” How true is this?

    By the way, I live in Iowa. I am educated about the legality of pot in my state, so I do not need anyone to tell me that it is wrong or inform me on any of the mental and physical risks. I am a good student and have exceptional grades. In no way shape or form does pot interfere with my school work.

    I'm not seeing any provisions for undoing a finalized adoption because the brother is a pothead but I may be missing something. I guess if it causes medical issues for the child and your parents don't make you stop or boot you out, they could argue the child's welfare is endangered by staying.

    Your parents are free to give you the ultimatum of stop smoking or get out. Their home, their rules. Respect them even if you don't respect the laws.

    I simply meant that I did not need people to tell me “weed is bad, don’t do it.” I’m saying I understand the risks and just wanted advice on the legality of the adoption issue part of the matter.

    Best bet is to stop, at least in your parents home. Don't keep your stash there either.
    Of course, I completely understand that in that aspect I ****ed up. Just wanted to make sure it wasn’t true that he could be taken away that easily.

    The fact your brother could not be easily taken away. Does not mean your parents do not believe he could be.

    If your brother finds and consumes some of your drugs, and ends up in the hospital, CPS would become involved. CPS could seek an emergency order pending further review to determine what your parents knew about your drug use and whether they took adequate steps to protect the child.

    If the police raid the house over your drug use, that police activity could similarly trigger CPS investigation and could similarly raise questions about whether the child was safe from your drug stash or exposed to your drug use.

    You're an adult. If you want to use illegal drugs, move out -- or at least have the decency to keep them out of your parents' home. Frankly, if you won't commit to that, your parents should tell you that you need to find a different place to live.
