    Default Reporting Statutory Rape

    My situation is as follows:

    1) I have a daughter that has a baby and is 15 y/o, I have not raised this child, she has a boyfriend 21 y/o the father of baby.

    2) I was put in jail in 1993 for alleged rape of mother, and was convicted because I pleaded out (did 11 years in prison). I have been on the child's birth certificate since birth.

    3) can I accuse the father of rape of this minor ? since I don't live with her ?

    Yes. Call CPS and report it.

    sorry for my ignorance but what is CPS ? Would it be Child Protective Services !
    if so where can I find a phone number ? what should I look under ?

    Try Googling for it with the name of your state, or looking in the phone book.

    Yes...Child Protective Services. You didn't say what state you are in, but this is the National Abuse Prevention Hotline. 1-800-422-4453

    You might want to call and report it to the police first, but you can report to CPS and they will forward the information to the police in the town your daughter lives in. The Doctor that your daughter saw is a mandated reporter, so don't be surprised if s/he already reported this to the authorities.

    No I don't think the Mother or the child (daughter) has reported any of it because the Mother has tried to get child support from the state (Florida) and come to find out she is trying to sue me now (4/7/07) for child support for the Child (daughter).
    Did I mention that the child (daughter) was only 14 y/o when she got pregnant and gave birth 2 month ago at 15 y/o..
    the father is 21-22 y/o and is an Illegal immigrant (mexico)

    so let me get this straight a 21-22 y/o should no way have intercourse and less yet a child with a 14 y/o in the state of Florida because this can lead him in jail right !!

    I am writting back, I have called the numbers that you have provided to me and some... but it seems to be very fine with the state of Florida that this child has done !! I have been given 7 different numbers concerning this matter and no one has tried to resolve it..
    The CPS department told me to conteact the Sheriff's department then I was told to contact the Child support services which is closed today..(will caqll tomorrow) but the sheriff's department has told me that I really can't press charges because once the child give birth she is Mancipated (but I'm liable to pay for child support) and that if the mother is fine with the situation (gives concent) that I can't do nothing about this !!
    I this really how the system works...

    I seriously need some HELP !!

    A child giving birth is NOT emancipated, who ever told you that is wrong and he/she may be confusing medical emancipation with child emancipation.

    The person that impregnated your daughter has broken the law, so it should be reported.

    Your child is still a minor and therefore you won't get off the hook for paying support.

    Not sure if that is what you are trying to do, but it appears that is the angle you are trying to take.

    If your daughter's mother is receiving state aid, then it may very well be that the state is going after you for the child support that the state has been paying.
