    Default Can I Recruit and Train People Overseas to Work in the United States

    My question involves labor and employment law for the state of: U.S.A. - No particular state.

    If I have a corporation here in the U.S.A., am I allowed to recruit citizens of India, Malaysia, and other countries, train them in their home country so that they can come to the U.S. to work for my company here in the U.S.?

    My reason for wanting to do this is not financial, I would pay them the same I would a U.S. citizen. My reason is to give opportunities to people in those countries who have a lot of potential, but are living in extreme poverty; and possibly in danger in their home countries.

    Sure you can Recruit and Train all you want, there's nothing to stop you.

    the problem you'll have is getting Visas to actually get them into this country. Most likely you'll have to prove you need their skills brought in because you can't find anyone here with the skills you require to do the job. Depending on how big your company is and how connected you are will help determine your luck in this endeavor.

    There are lots and lots of people right here in the US who need jobs and opportunity.

    Your ideas are laudable, but the truth of the matter is, before you will allowed to bring these folks into the US to work, you will have to prove to the satisfaction of USCIS that no US citizen can be found who can do (or be trained to do) the job first. They will not be issued work visas otherwise.

    Thank you both for taking the time to reply and help me. So, I see. This makes me think I might be better off helping these people qualify (TOEFL, etc.) to come here legally to study, and then offer them employment? I'm not trying to "trick" the system, just was wondering if there is some manner it could be done legally.
    cbg thank you for your compliment, and I understand what you're saying about US citizens needing jobs and opportunities. I didn't mention it in my original post but it's not that I want to go out and search for needy people abroad, it's a personal thing. I had a friend who passed away a few years ago. When she was young, in her country, she worked in a sweat shop situation. I recently looked into it further, visited, and found the place I came home obsessing over what I could possibly do to help the girls who are now going through what my good friend once did. That's when I thought it would be one way to honor her memory to offer them the opportunity if they were interested and qualified to do it.

    You're still going to run into visa issues. Even if you are able to get them here on a student visa, they cannot automatically stay and work after they graduate. They still would need to have a work visa, and that requires proving that there is no US citizen available to do the job.

    Brainstorming a bit off topic--> You might think about looking into missions /churches that provide training to locals. They often provide housing/food etc needed to the locals while in training for better jobs in their home country. Some "purchase" these people out of what they have been sold into by parents/others. This helps them have a better life where they are. Because in reality, do they really want to leave their homes/families/culture to come to the USA? I know we have the land of golden opportunity, but are we really providing a 'better life'? Or just the American life? Should we truly bring them into our country/force our culture ---- will they truly be happier in the end? One such organization is out of SC and called Set Free Alliance if that is truly something you are interested in supporting.
