    Default Request for Evidence About Employment for F2 to F1 Change of Status

    I initially came to the U.S. under F1 and then changed to F2 after graduation. Now I got admitted to a school in a totally different major and applied to change my status from F2 to F1. I've got the Request for Evidence . The first one in the list is "EOS/COS - Extended Stay in US or Leave of Absence". It says "A review of the record indicates that you have been away from your home country for an extended period of time. Submit documentary evidence that you have been authorized vacation or leave of absence for the period of time already spent in the U.S. and requested on the application." I've been in the U.S. for all those years and those "vacation or leave of absence" don't apply to me. How should I respond to this request? Many thanks!

    The USCIS appears concerned that the ties you reported to your home nation at the time you last obtained a visa no longer exist, and thus that you might remain in the U.S. at the end of any authorized stay. So from what you have told us so far, you would want to provide them with documentation of your ties to your nation of origin so that they can be reasonably reassured that you will in fact return home at the conclusion of your studies.

    Thank you! As I said, I initially came to the U.S. as F1 and changed to F2. I've always been maintaining the status. I traveled several times but they were short trips like 1 or 2 weeks. Could it be because that I've stayed in the U.S. too long? Is there any limit about how long I can stay in the U.S. under F status, no matter it's F1 or F2? Many thanks!

    Your F2 status is what allows you to enter and leave the U.S.

    Your duration of stay is described on your I-94.

    I thought the duration of the F2 was tied to the F1 of holder it is tied to?

    It says D/S. During status... So I guess there's no limitation of the length of stay as long as my F1 maintains the status... I wonder why this request. Should I just say I've been in the U.S. all the time and the "authorized leave absence" is not applicable? What evidence do you suggest me to provide? Visa stamps on my passport? Thank you!

    Right. But then there's no time limit about F1/F2. We have never been out status. Do you have a suggestion about how to respond? Thank you!

    What evidence do you possess that may help convince the USCIS that you will return home at the conclusion of your studies? Employment, financial ties, property ownership or leases, family connections, employment, etc.
