    Default Possession of Marijuana and Suboxone

    My question involves criminal law for the state of: minnesota

    My girlfriend got pulled over today. She is a good hard-working 24 year old female currently working full time and pursuing a nursing degree. However she likes to smoke her marry Jane! Her occasional glass of wine and her marry Jane habit are the only mind altering substances she consumes, and has been that way for as long as I’ve known her (2.5 years). This is the reason I am so upset and disgusted with what went on today. When the cop came up to the car he smelled the weed and she was honest with them right away and told them where it was. (2 grams ish) Obviously the cop continues to search the car and comes across an unmarked bottle with a half a pill in it. Keep in mind she’s a stoner so her car is pretty messy and always has been since I’ve known her. I say that because this half a pill could go back to when I was briefly prescribed them when I kicked my Percocet addiction. But it was only a half of one and she never has touched any opiate in her lifetime. They told her that she has two options: either take a mistermeanor and/or felony charge: or she needs to answer a call from the lead detective Monday or Tuesday and work with the police wearing a wire to bust her pot dealer. This doesn’t seem right at all! This girl has been though and overcame many obstacles in her lifetime and has a great job and back in school perusing a great career. She has an absolutely clean record I can’t wrap my head around the fact that they think they are helping and serving the community by messing with a good young woman’s life like this. Right her a ticket and get on with your day and bust some real criminals. Not someone who smokes a little weed to help with her anxiety. Thought and ideas or advice would be greatly appreciated!

    She needs to talk to a criminal law attorney first thing Monday morning.

    The cop did not charge her with anything on the spot. She got no ticket or anything. He let her drive and go to work but he said that she needs to answer the phone Monday or Tuesday when the detective calls her. Is there a chance he’s bluffing? It’s messed up they manipulated her to try and get her to be an informant for them. Young adults have been killed for doing that type of stuff. It’s unbelievable they corner people like this over such s petty crime.

    Sorry he said she needs to answer otherwise she will get charged with a felony possession.

    Again, she needs to speak to an attorney BEFORE she speaks to the police again.

    Life is so unfair isn't it? Being a young adult who's had to overcome hardships should get you a pass when you break the law! Oh, wait...nope. It doesn't work that way.

    The cop didn't manipulate her, he offered he a choice and I agree that she should speak to an attorney before doing anything. Suffice to say, she confessed to the cop and was busted with the drugs in her possession after confessing and permitting the search. Nope, no manipulation there.

    A big issue is that, as a nurse, drug convictions can be a career killer.

    So, to recap: no manipulation, doesn't matter if she's a good hardworking woman who's overcome difficulties, she should speak to an attorney AND her career is now in jeopardy.

    That should cover it.

    Nobody here knows the judges and prosecutors in your jurisdiction. A criminal defense attorney in your area does. That person can advise how cases like this are typically handled, whether a diversion program is available to her, etc. Attorneys are also "counselors at law" which means the can guide her to the best solution for her problem. Nobody on the internet can do that for her.

    Going forward, I can advise her - follow the law and get rid of her relationship with Mary Jane, or else move to Colorado.

    She could almost kiss her nursing degree away, if she is charge with a drug crime.

    Rule number one: Don't ever smoke weed in a vehicle, the smell lingers on for hours. Someone that isn't smoking it can smell it well after you can no longer smell it. And don't say that she wasn't smoking and the officer smelled 2 grams of weed, if so then they wouldn't need police dogs to sniff for that little bit of weed.

    She is in possession of the pill so she is the one that will be charged with it, however, you could go to court and explain that the pill is yours to get her off the hook. The only problem with that is, you need to convince the judge that the prescription was yours and being that it was in an unlabeled container, you stand a chance to be charged with the drug crime.

    Half a pill or a bag with 200 pills is the same crime if you don't have a prescription.

    If she wants to keep her job and keep going to school then she has one more obstacle to overcome, she better run for the phone when it rings.

    The police are not messing with your girlfriends life, she is. She is the one driving impaired while smoking weed in a vehicle and in possession of medication without a legal prescription.

    I have an idea, have your girlfriend get a legal prescription from a doctor to treat her anxiety.

    Actually, most officers receive training on detecting and identifying the odor of raw marijuana, not just burned cannabis.

    Sure, I can even detect raw marijuana if the right quantity were there. Both raw and burnt marijuana each have a distinctive smell. But I don't even think a police officer that was trained to smell raw marijuana can sniff out a dime bag or two at the bottom of a pocketbook or hidden in a vehicle compartment. Police departments leave that job for Rover.

    When you were a kid and you went home for dinner, if your mom was cooking stew, you smelled stew.

    A dog on the other hand doesn't smell stew, he smells each individual ingredient added to that pot.
