    Default Judge vs. Prosecutor and Deffered Adjudification in Texas

    I was recently caught shoplifting with a friend in a Kholes department store in Austin, Texas. There was $126 of merchandise in my purse and none in hers, but we were both ticketed with attempted theft b. my court date is in about a month with a prosecutor, im told this is not the same as a judge. ive never been in trouble before what-so-ever, i never even skip school. im 17 and on my way to a&m this fall, i make great grades. what are my chances of getting deffered adjudification? and also what is the difference between a judge and a prosecutor? i need all the information i can get to help me keep this off of my record for good!

    A judge is the guy who sits behind the bench (big desk) and decides the case (with or without a jury), and sentences you. The prosecutor is the guy who authorizes the charges against you, offers you a plea bargain, tries to get you convicted if you don't plead guilty, and if he wishes asks for a tough sentence.

    You will probably have to ask a local criminal defense lawyer about your court's sentencing practices to find out if deferment is possible. Check the county court's website for information on diversion programs or deferments.
