I disagree with you. The OP is an employee based on their post.

While the test does differ somewhat from state to state, the basic points are:

Does the employer control what the employee does. Is the IC in control of their own work? Is there a start and finish date for a project? Is the work being done at the employer's place of business? Is the employee using the equipment of the employer? Is the work being done the normal work of the employer? Is the IC serving other clients? If the relationship of employer and employee was terminated, will IC remain financially solvent?

In this case the answer is that OP is an employee according to what has been posted.

The question to OP is what do they want to do about it.
