    Default What is the Penalty for a Second Offense Domestic Violence Charge

    My question involves criminal law for the state of: Canada, Ontario

    I am the victim of a domestic assault, more than once but I am unaware of what will happen next and the severity my partner, well now ex partner is facing.

    On Sunday night my partner assaulted me while trying to get my bank card when I refused. He struck me in the face several times slapping, as well with a closed fist leaving me very dizzy. He bit my arm trying to get to my bank card which I finally let go of- My ex partner was high on a substance and I believe definitely added to the severity of the assault. The concierge of his building came up and informed him neighboors had called the police in which case my partner fled, as the conditions before were for him and I to not have any contact with one another, and that was the terms of his conditions. Also that he was supposed to reside at his parents house not at his condo. I was left there on the floor a few minutes passed his concierge entered his residence then shortly after I was put on a stretcher and taken away in an ambulance. My face was noticably very swollen and was obvious I had been hit several times. I had to get a cat scan and a tetnis shot from where he had bit me.

    The police found him in his parents vechicle, he went to his parents house (Where his entire family is in Florida at the time being they return in March) and switched vechicles, he was arrested.

    This was not the 1st time he was arrested for assaulting me, on Christmas eve police came into his condo and arrested him after he had struck me in the face, I did not go to the hospital I just went directly to the police station to give my statement.

    My question is does he serve jail time now? Since he has breached his bail conditions, also he was found with drug paraphernalia on him at the time of the arrest. My ex does come from a well off family and does have a good lawyer from the first time he was arrested on Christmas eve.
    I have also enquired about setting up a request for my property removal from his condo. I feel mad at myself that I went back to him thinking that he would change and not become violent towards me anymore. But after this last assault and the physical damage he has left on me I will never re consider taking him back.

    I am not sure if he will be sent to jail automatically for breaching his probation or his bail was denied?

    You should speak with the crown counsel assigned to the case, or somebody in that office who handles questions from crime victims.

    I'm not sure on how much time he will receive as your in Canada but u would think more time then the first time.

    Very smart of u to not go back to him a 3rd time.

    Plus u said he had a pipe on him. If his family has allot of money it's possible he might get out of it hard to say
