    Default How to Report Somebody for Bankruptcy Fraud

    My question involves bankruptcy in the state of: TN

    My question is about reporting suspected bankruptcy fraud.

    I am in possession of prison phone recordings of an individual discussing what I believe could be bankruptcy fraud. (The back story as to how I came into possession of these is complicated!) Anyway, while in prison, this individual stated his intent to file for bankruptcy after getting out of prison, and instructed his business partner/wife not to use any money coming into the business to pay off any of their business debts, including a promissory note, since all of these debts would be taken care of by the bankruptcy. Well, instead of immediately filing for bankruptcy after he got out of prison, he and his partner, over the next year and a half, proceeded to accrue approximately $100K in additional debts, including lines of credit related to a new business (basically the same business but in his wife's name only), personal credit cards, home furnishings, medical bills, lawyer fees, and personal loans. He and his wife have now recently filed for bankruptcy, asking to wipe out all of these debts, as well as his old tax debts of approximately $200K. I also happen to know that some of the wages from his wife's second job were not reported on the bankruptcy form.

    Is any of this fraud? This guy has previously been convicted of, and is currently on probation for felony theft of trade secrets, as well as sexual battery of a minor. It sickens me that he continues to exploit innocent people, and seems to be getting away with it. I want to do something, but unless there is a chance that he will actually get prosecuted, I do not want to stick my neck out and provide this evidence, since there is really no way for me to do it anonymously.

    The details matter. Not disclosing income on the bankruptcy schedules would amount to bankruptcy fraud if the disclosure would make a difference in the outcome of the bankruptcy. If it is a Chapter 7 bankruptcy the unreported wages of the wife may not make that much difference unless it were to result in forcing conversion to a Chapter 13. Accruing debt with the intent to never repay it and instead discharge it might also be fraud against the creditors. But without reviewing the details of it all no one here can tell you how likely it may be that he would get charged with anything out of this.

    J: But we don’t want to mess the opera up because, we want to keep all those renewals up, because, I mean you’ve seen all those advertising. If you total it up it’s almost $50,000 in renewals for [the] Opera, so that’s money you’re going to need.
    Wife: Okay. Are you sure that it’s okay to keep this going and all that?
    J: Well yeah, yeah. Then I’ll just, you know, I’ll just have to file bankruptcy. It’ll be fine.


    Wife: Well then your dad got some promissory note about the Opera from some lawyer about $5000 dollars. What is that?
    J: I don’t want you to worry about that, okay? That’s nothing that, you know, I’m going to have to file for bankruptcy, you know, that’s just something we have to do. I don’t want to take the money that you just got, and use it for that, okay? I’m not about to do that.


    J: I’m probably going to have to file bankruptcy, okay? If I do that, the car will have to be included, and I’ll lose it anyways.
    J's son: Right.
    J: But, um, so just ask Dad, or, yeah, Grandpa to call that car place up and ask them if there’s any way they can, you know, for these last $3000, you know, refinance it, and put it in your name, you know what I mean? And then once I get out I’ll be able to pay more on it, and pay it off, and then it’ll be—
    J's son: You’ll have your nice Xterra back
    J: Yeah, but it’ll be in your name, and it’ll be something that shows that you paid it off.
    J's son: Yep.
    J: ‘Cause it would be nice to have a car when I get out of here.


    He never actually did the car thing.
