    Default Domestic Violence Charge for Hitting Phone Out of a Spouse's Hand

    My question involves criminal law for the state of: Maine.
    I was arrested for assault for attempting to hit my husband's phone out of his hand when he was on it and not helping clean. I've never been in trouble before and never was trying to hurt my husband or his phone. I need advice about trying to get the case dropped/dismissed and trying to get my bail conditions modified so I can go home to my husband.....PLEASE HELP!

    This is one of those situations when the DV laws just confound me. I can’t believe you, as a female, were arrested for that let alone that your husband called the police for it. In my state most DVs involving female defendants get dropped by prosecutors anyways, but that’s just absurd. Especially considering all the professional fields that a DV conviction could get you barred from.

    You were not arrested and charged with assault because you were attempting to hit your husbands phone out of his hand. There is much more to this.

    So what was your intent, then? You say you didn't want to hurt him or the phone, yet you struck him. So what was your hoped-for result?
