    Default How to Get the Police to Return Seized Money With Proof of a Legitimate Source

    My question involves criminal law for the state of: Texas

    To start off I had won approximately $13,000 at a casino in Oklahoma last Thursday. On Friday I had purchased a vehicle but was not able to update my tags because it was purchased late in the day so I had to wait until Monday for that. However, I was stopped on Sunday by police because of the tags being expired. After giving police my ID I was told that I had a warrant from another state on old charges that I thought were dropped and got arrested in the process. While being arrested they took my winnings from the casino (I had roughly $7000 on me at the time) and seized it in evidence. My sister had given the police my W2 form from the casino to prove that I did in fact receive it from the casino but because I was arrested on Sunday they had to wait until Monday to call for verification. I was released from jail Monday night after the state where the warrant was issued decided not to get me. Today I went back to the police station where I was initially taken and my money was seized and was told from a receptionist that I had to talk to a detective working my case. I don't understand how there is a case when I was arrested on a warrant and after providing the paperwork needed I still have yet to get my money back. What else needs to be done in order to receive my winnings back?

    First you need to speak to the detective. Do you really think a receptionist can hand over $7k?

    Seized it for what reason? Was there a criminal offense it was taken for? Did you sign any paperwork stating the currency was seized? We're you provided any paperwork stating the currency was going to be seized under Texas Civil Asset Forfeiture laws? If so, you would need an attorney...

    What may have happened is that your large amount of currency was probably taken into safekeeping because, well, how truck drivers have a tendency of losing some items and the jail may not accept that much currency into their property system.

    Who knows. Did you ever call the detective? If it's administrative forfeiture then the clock is ticking (for you). If it ticks too many times you lost your money for eternity
