    Default Getting Out of a Car Contract

    My question involves a consumer law issue in the State of: Texas, traded my old car and the guy did Kelly blue book wrong. Also I repeatedly said no and they kept going, should have walked out. The terms weren’t Clair in regards to the interest, so I can claim capacity and duress. Any way out of this?

    Unless they knew you were mentally incapable of understanding things, there's no way to argue capacity. When you're in a retail establishment, you were free to go. The hard sell is not duress. The terms of the loan should have met the Truth In Lending Act disclosure (almost certainly is), the fact you didn't understand them is not an error on the lender's part. I have no idea what "did the Kelly bluebook wrong" means in this context.
