    Default Enforcement of Child Support and Alimony Through a Support Enforcement Agency

    My question involves a child custody case from the State of: NY
    I went to Family Court in December of 2017 and got a modification approved to have child support and alimony go through the Child Support Enforcement agency. However, one month in and my ex is not paying. I spoke with the CSE and apparently they have sent two letters to his employer and have not heard back from them. According to the CSE my ex is responsible to make sure the employer follows through with the income execution order. My question - does any one have advise on how to proceed besides going back to court? Can I contact his employer to nudge them? Should CSE follow through (they tell me I can contact the County who will go after the employer). But besides that the CSE says I will have to do the leg work. I thought that was the whole point with the CSE, that they would enforce payment and do the legal work for you.

    I can tell you that in my case in Ohio, Child support didn't start getting sent to me for 6 weeks after the order went into effect. I know that doesn't answer your question, but it could just be that it takes time.

    I would not contact his employer. It can be frustrating when things seem to move slowly, but let the appropriate agency deal with this. Even if he's not currently paying, he is accruing arrearage.

    No you should not contact the employer. First they have no reason to talk to you. The CS order came from CSE not you or your lawyer. Second, if they are not responding to the order you need to "nudge" CSE to take the legal steps they have under the law to force the employer to start deducting the order and submitting it to CSE.
