    Angry Can an Adult Get Emancipated from a Parent

    My question involves juvenile law in the State of Alabama:

    Can I be emancipated as an adult. I want NO ties to my "mother". She was abusive mentally, emotionally, & sexually.
    She has some serious mental issues, which I am unsure if they are diagnosed or not.
    She has broken into my and my wife's home.

    She has used her physical illnesses and contacts to sway a judge into giving her overnight, unsupervised visitation with my infant son, despite both his parents' objections.
    We have appealed this, but have heard silence from the higher court.

    Would this free my son, if I could emancipate myself from being her son???

    She threatened (and I believe planned) to kill my wife. The judge said this was just her "running her mouth" since she said it to me, & not my wife.

    She sues me over nonsense, trying to take my car, for slander (over reporting abuse), etc.

    I want all ties cut with her.

    I want to change my last name, she gave me her maiden name, instead of my father's name even.

    This is mainly to stop her "rights" for visitation with my son, and protect him since the court is not listening about her beating and raping me, or making advances toward my child as well.

    First off, there's no such thing. Second, even if you were a minor, emancipation wouldn't stop any of these behaviors.

    You should consult an attorney as to what options you have. He can especailly address the risk of abuse to the child in the visitation.

    Emancipation isn't an option. You were automatically emancipated the day you turned 19.

    You can change your name tomorrow and have no other contact other than the visitation of the child. And I'm betting that you have heard nothing from the higher court because you or your lawyer failed to file an appeal. Because there is a US Supreme Court decision out there (TROXEL V. GRANVILLE) that is counter to the ruling as you describe it above.

    If you disobey a court order to provide visitation to a grandparent you cannot lose custody of your child. You can be heavily fined, you can go to jail for contempt of court but you cannot lose custody of your child nor can the courts place your child with someone you disapprove of just because you go to jail for contempt of court for refusing to honor a grandparent visitation order.

    A grandparent also cannot stop you from moving to the other side of the country just because they happen to have a grandparent visitation order.

    I suggest that you consider moving across the country if that makes sense for you, and get a consult with a local attorney who is experienced in fighting these kinds of cases for parent.
