    Default Asked to Fill Out 1099 3 Months After Quiting

    My question involves independent contractors in the state of: Arizona

    Hi and thanks!

    I worked as a bike courier for about 4 months this summer/fall. Never filled out any paperwork. All cash under the table. Now 2 months after quiting I'm being asked for my SSN for 1099 purposes. I'm hesitatn to give this out since they were quite opposed to my leaving for a new job, and I haven't heard from them since.

    Can they legally ask me to do paperwork they should have had me complete months ago before I started the job? I started in July 2017 and quite in November 2017.

    Of course the company may ask you for the information. However, you are under no obligation to provide it. You are required by law to fully report your earnings on your federal and state income returns, though, regardless of whether the company files a Form 1099-MISC for you.

    If they properly made the request before the end of the year, he was obliged to report it by law (though the penalty for failing to do so is trivial). If they didn't send make the request before December 31, they screwed up badly (actually, they should have sent the W-9 out in a timely fashion if they didn't have the information they needed).
