I was recently terminated after 10 years of employment for using the phone/internet for personal use on company time. I am part of a union and our contract (and the employee handbook) states that termination (even for determining just cause) must follow progressive disciplanary action (verbal, 1st written, 2nd written, final written, termination). I was never disciplined, counseled or otherwise spoken to regarding my internet/phone usage. Additionally, all members of staff use company property for personal use. I applied for unemployment benefits (along with filing a grievance with my union) and have subsequently been denied. I, of course, may file an appeal, but need to know what my chances are of actually being granted my benefits and what sort of information I should include with my appeal letter.
